LAKEVIEW PHYSIOTHERAPY & ACUPUNCTURE LTD. – PRIVACY POLICY

Introduction

1.1       Lakeview is committed to using best practices to safeguard Users personal information, in accordance with Alberta’s Personal Information Protection Act and other applicable laws.

1.2       This Privacy Policy governs Lakeview’s collection, storage and use of Users’ Personal Information and is incorporated by reference into Lakeview’s terms of use agreement (the “Agreement”). The defined terms herein have the meanings given to them in the Agreement unless otherwise defined within this Privacy Policy.

1.3       “Personal Information” is information specific to You such as Your name, email address, address, postal code, phone number, gender, date of birth, health information and financial information. Further to that definition, Personal Information specifically does not include publicly available information such as business contact information, nor does it include information of an anonymous nature, such as the type and version of browser or operating system being used by You in visiting the Website.

1.4       This Privacy Policy describes how we use Your Personal Information, and under what circumstances we may share it with third parties. This Policy also describes the decisions You can make about Your Personal Information. You may request that we change, amend or delete the Personal Information that You have provided to us at any time.

1.5       Lakeview is responsible for Personal Information under its control, including the transfer of Personal Information to a third-party service provider for processing on Lakeview’s behalf. This Privacy Policy is not intended to, and does not, create any contractual or other legal rights in or on behalf of any party.

1.6       The Privacy Policy is subject to change without notice, and it is Your responsibility to review the Privacy Policy posted on the Website on a regular basis. Your continued use of the Website indicates Your acceptance of the changes.

1.7       At any time You can contact Lakeview to review the Personal Information of Yours held by Lakeview, and amend Your Personal Information. If You wish to withdraw Your consent for Lakeview’s use of Your Personal Information, You must notify Lakeview, cease using Lakeview’s Website, terminate the Agreement with Lakeview, and close Your account.

Lakeview’s Use of Personal Information

2.1       When You visit the Website, its servers record Your web browser activity including Your IP address. When You make a booking through the Website, Lakeview collects the Personal Information You provide. Your consent is implied when You provide such Personal Information.

2.2       By using or accessing this Website or the Services, and by providing Personal Information, You agree that Lakeview may collect, transfer, store, and otherwise use Your Personal Information and may disclose such Personal Information to other third parties for commercial purposes or as required by law, including without limitation for the following purposes:

(a)         providing products and Services to You and reminding You of appointments;

(b)        collecting and processing payments and billing and authenticating accounts;

(c)         receiving or providing feedback or comments;

(d)        providing information to third-party health benefit or insurance providers, to Your lawyer if You were injured in an accident; and to other health-care professionals providing You with treatment;

(e)        learning more about You and Your product preferences through monitoring Your IP address activity on the Website;

(f)          enforcing this Agreement; and

(g)         responding to claims of any kind, including without limitation infringement of any property or privacy rights.

2.3       Lakeview will ask You for Your express permission to send You information about Services or promotions. If You have given such permission, You may at any time withdraw Your consent by notifying Lakeview, and Lakeview will cease sending You any such material.

2.4       You agree that Lakeview retains the express permission to disclose Personal Information to the appropriate authorities in the event that Lakeview, in its sole discretion, has reason to believe that the safety of any User or third party may be in jeopardy or that any unlawful act may have been, is being, or may be perpetrated.

2.5       Lakeview uses browser tracking cookies and log files to recognize Your use of the Website and track Your activity on the Website, and may customize messaging and content to You by recognizing Your IP address. Information stored on web servers via collection by cookies does not include visitor names and addresses. You may accept or decline the use of browser tracking cookies; however, without the use of cookies the Website may not function optimally.

2.6       The Website may feature third-party advertisers which may set cookies. These cookies allow the server operated by that third-party advertiser to recognize Your computer each time they send You an online advertisement. Accordingly, advertisement servers may compile information about where or whether You viewed their advertisements and which advertisements You clicked on. This information allows web advertisers to deliver targeted advertisements that they believe will be of most interest to You. This Privacy Policy applies to cookies placed on Your computer by us, but does not cover the use of cookies by any third-party web advertisers.

2.7       Lakeview may use third-party providers such as payment gateways and other payment transaction processors. These third-party providers have their own privacy policies in respect to the information Lakeview is required to provide to them for Your purchase-related transactions. You are advised to read their privacy policies. If You chose to proceed with a transaction that involves the services of a third-party provider, Personal Information You provide may become subject to the laws of the jurisdiction in which that third-party service provider or its facilities are located.

2.8       Lakeview takes reasonable precautions to ensure Your Personal Information is kept and stored in accordance with generally accepted industry standards. Lakeview will limit collection of Your Personal Information to what is required to optimally perform the Services, including use of the Website.

2.9       Lakeview will keep Your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of the Agreement. Lakeview may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. All retained Personal Information will remain subject to the terms of this Privacy Policy. If You request that Your Personal Information be removed from our databases, it may not be possible to completely delete all Your Personal Information due to technological and legal constraints.

Protection and Storage of Personal Information

3.1       Lakeview limits its collection of Personal Information to what is needed to provide Services to You and facilitate booking and billing services.

3.2       Lakeview takes measures to protect Your Personal Information that include, without limitation:

(a)   using a third-party payment system (currently Jane App) to ensure secure payment transactions;

(b)   using firewalls and anti-malware to protect information held in our servers; and

(c)   using highly secured third-party platforms.

3.3       Lakeview may process temporary hard copy files containing Your Personal Information at Lakeview’s place of business for the purpose of providing the Services to You. Lakeview’s processing of such files consists of scanning and returning hard copies to You or shredding.

3.4       Lakeview ensures its employees are aware of and agree to comply with confidentiality requirements with respect to clients’ Personal Information and with this Privacy Policy. Staff are trained to report any suspected privacy breach to Lakeview’s Privacy Officer.

Disclaimer and Liability

4.1       Lakeview shall not be liable for any damages howsoever arising for the disclosure, invasion, corruption, transfer, publication, or distribution of Your Personal Information and its security. You understand that providing Personal Information to any Website including to Lakeview comes with some security risks that cannot be predicted or controlled by Lakeview. Accordingly, You assume all risks relating to the any security breach of the Website and disclosure of Your Personal Information.

4.2       You understand that electronic communication is not a secure method of communicating confidential and Personal Information; however, due to its convenience, You agree to and authorize the use of electronic communication, and You accept all the inherent risks associated with this type of communication, except as otherwise directed to Lakeview by You in writing in advance of a specific communication.

4.3       The Website may contain links to third party websites and may use third-party service providers. Lakeview is not responsible to You or to any third party for the privacy practices of such websites and third parties, and You use any such websites and third-party services at Your sole risk. Lakeview is not responsible for the privacy practices of other service providers or websites that You use or access in any way, including through Lakeview’s Website.
